AN ACT TO PROMOTE SUSTAINABLE AGRICULTURE AND THE USE OF INTEGRATED PEST MANAGEMENT.

          Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
          SECTION 1. Chapter 64H Section 6 of the General Laws is hereby amended in subsection (p) by deleting item (3), and renaming item (4) as item (3).
          SECTION 2: Chapter 29 of the General Laws, as appearing in the 1998 Edition, is hereby amended by inserting after Section 2VV the following new section: -
          Section WW. There is hereby established and set up on the books of the Commonwealth a separate fund to be known as the Integrated Pest Management Fund. The following revenue sources shall be credited to the Integrated Pest Management Fund:
          1) The revenue created by the taxation of sales of fertilizer, including ground limestone, hydrated lime, insecticides, fungicides, seed inoculants, seed disinfectants and plant hormones, as well as other substances commonly regarded in the same category and for the same purpose. These are the sales which were exempt from taxation under Chapter 64H, section 6(p)(3) of the General Laws, as appearing in the 1998 Edition, abolished by Section 1 above;
          2) All revenue collected by the Department of Food and Agriculture from fees associated with the issuance of pesticide certificates and licenses pursuant to Section 10 of Chapter 132B;
          3) All revenue collected by the Department of Food and Agriculture under Section 7 of Chapter 132B for the registration of pesticides;
          4) All revenue collected by the Department of Food and Agriculture under Section 9 of Chapter 132B for issuing pesticide dealers' licenses;
          5) All revenue collected by the Department of Food and Agriculture under Section 8 of Chapter 132B for the issuance of experimental use permits; and
          6) All revenue collected by the Department of Food and Agriculture under Section 14 of Chapter 132B for violations of the provisions of Chapter 132B, excluding fines for violating sections 6C through 6I of that chapter;
          All amounts credited to such fund shall be used, subject to appropriation, for the integrated pest management program, operated by the Department of Food and Agriculture, funded in item 2511-3002 of Section 2A of Chapter 159 of the Acts of 2000 for purposes including, but not limited to: education, outreach, research, labeling, and creating and providing incentives to use integrated pest management; provided that the Department of Food and Agriculture make at least 50% of such revenues available for the same purposes at the University of Massachusetts; provided further that the University shall not assess any overhead costs or charges to monies allocated to said University from the Integrated Pest Management Fund.
